Terms and conditions of purchase

Introduction:

This purchase is governed by the following standard terms and conditions of sale for consumer purchases of goods over the Internet. Consumer purchase here means the sale of goods to consumers who are not primarily acting as part of a commercial activity, and when the seller is acting in a commercial capacity with the sale of goods over the Internet. The contract has been prepared and recommended for use by the Consumer Ombudsman.

Consumer purchases over the Internet are regulated by the Consumer Purchases Act, the Marketing Control Act, the Cancellation Act and the E-Commerce Act, and these laws provide consumers with mandatory rights. The terms of the contract should not be understood as a limitation of the statutory rights, but set out the parties' most important rights and obligations for the transaction. The seller may choose to offer you better terms than those set out in these terms of sale.

In cases where the contract does not directly provide the solution to a problem, the contract must be supplemented with relevant legal provisions.

Strie Strømmer reserves the right to change the terms and conditions as a result of circumstances such as changes in legislation or changes in other social conditions.

1. The agreement

The agreement between the buyer and the seller consists of the information the seller provides about the purchase in the ordering solution in the online store (including information about the nature, quantity, quality, other properties, price and delivery terms of the goods), any direct correspondence between the parties (for example e-mail) and these terms and conditions of sale).

In the event of a conflict between the information the seller has provided about the purchase in the ordering solution in the online store, direct correspondence between the parties and the terms and conditions of sale, direct correspondence between the parties and the information provided in the ordering solution takes precedence over the terms and conditions of sale, unless this is contrary to binding legislation.

3. Pricing

The prices stated in the online store are in Norwegian kroner and include VAT, unless display excluding VAT is selected.

Information about the total costs you will pay, including all taxes (VAT, customs duties, etc.) and delivery costs (freight, postage, invoice fee, packaging, etc.) as well as specification of the individual elements of the total price, is provided in the ordering solution before the order is placed. (Deliveries of goods to persons with a permanent address on Svalbard or Jan Mayen shall be sold without the addition of VAT. (1)

4. Conclusion of the agreement

The agreement is binding for both parties when your order is received and confirmed by Strie Strømmer.

However, a party is not bound by the agreement if there have been typing, typing or technical errors in the offer from Strie Strømmer, in the ordering solution in the online store, or in your order, and the other party realized or should have realized that there was such an error.

5. Order confirmation

When Strie Strømmer has received your order, Strie Strømmer shall without undue delay confirm the order by sending an order confirmation to you. All order confirmations are sent out automatically. If there is an error in the stock status on the website (that the warehouse is empty), we will contact you.

Orders will be processed in the order in which they are received and this may mean that the ordered item may be sold out, even if the website shows that the item is in stock at the time of ordering.

We also note that our prices apply to the items that are in stock at the moment of approval.

It is recommended that you check that the order confirmation matches the order in terms of quantity, product type, price, etc. If there is a discrepancy between the order and the order confirmation, you should contact us as soon as possible.

6. Payment

Strie Strømmer may demand payment for the item from the time it is shipped from Strie Strømmer to you.

If you use a credit card (2) or debit card (3) for payment, Strie Strømmer may reserve the purchase price on the card when ordering for up to 4 days from the order.

- 2) A credit card is a payment card where the purchase is settled afterwards by the creditor (the credit card company) sending the cardholder an invoice requesting payment.

- 3) A debit card is a payment card linked to a deposit account. When the card is used, the user's account is debited and the amount is transferred to the payee's account.

In the event of payment by credit card, the Credit Purchases Act etc. will apply.
If Strie Strømmer offers post-invoicing, the invoice to you shall be issued upon shipment of the goods. The due date shall be set to a minimum of 10 days from the date you receive the shipment. Post-invoicing is only offered to corporate customers after credit assessment.
Buyers under the age of 18 can only pay directly upon delivery of the goods by Strie Strømmer or by delivery of the goods by cash on delivery.

7. Delivery

When will my order be delivered?

In most cases, items in stock will be shipped within 48 hours.

How will my order be delivered?

Smaller parcels and paddles are sent using Posten and Postnord's services for delivery to a post office or store. You will receive a collection notification and can collect the parcel at the specified delivery point. Packages sent with these services will have a return shipping label enclosed so that you can easily return goods.
Some smaller products such as nose clips and earplugs will be sent by letter post. These will not have a return shipping label attached, but the shipping price will be significantly lower than if they were sent as parcel post.
Kayaks are shipped with DB Schenker. When ordering a kayak, it is important that you enter a company or office address that is serviced during the day as the delivery address, as DB Schenker charges a surcharge of NOK 975,- to deliver a kayak to a private address. If you have not provided a company or office address that we can ship to, we will contact you before processing the order.

Where can I order?

You can order to Norway, Sweden, Finland and Denmark. However, kayaks can only be delivered in Norway.

What is the shipping cost?

Instead of having a detailed freight calculation for each individual shipment. We have divided the shipping prices into different steps.

Prices for delivery in Norway: Free shipping in Norway on orders over NOK 1500 incl. VAT excluding kayaks.

Small parcels that can be sent as letter post: NOK 60,- incl. VAT
"Ordinary parcels": NOK 160,- incl. VAT.
kayaks: NOK 1500,- incl. VAT.

Prices outside Norway:

Regular packages: NOK 350,-

Years: NOK 700

Kayaks: Unfortunately not possible. Choose Pick up at Strie Strømmer and organize shipping yourself.

If you want to pick up your order yourself, or pay for shipping yourself, select Pick up at Strie Strømmer as your shipping method.

Delivery of the goods from Strie Strømmer to you takes place in the manner, at the place and at the time specified in the ordering solution in the online store.

If the time of delivery is not stated in the ordering solution, Strie Strømmer shall deliver the goods to the buyer within a reasonable time and no later than 30 days after the customer's order. If Strie Strømmer is to arrange for the goods to be sent to you, Strie Strømmer is obliged to have the goods transported to the destination in a suitable manner and on the usual terms for such transportation. The place of destination is your premises unless otherwise specifically agreed between the parties.

8. The risk for the goods

The risk for the item passes to you when the item is taken over by you in accordance with the agreement. If the delivery time has arrived and you fail to take possession of an item that has been made available to you under the agreement, you still bear the risk of loss or damage due to the characteristics of the item itself.

9. Offer/accessibility

Offers, services and products are valid while stocks last.

10. Right of withdrawal

You can cancel the purchase of the item in accordance with the provisions of the law on the right of withdrawal. The right of withdrawal means that you can return the item to Strie Strømmer without reason, even if there is no defect in the item.

You must notify the seller of the right of withdrawal within 14 days of receiving the goods, the prescribed information about the right of withdrawal and the withdrawal form. If you receive the withdrawal form and the necessary information at a later date than the delivery of the goods, the withdrawal period starts from the day you receive the withdrawal form and the information. If you have not received sufficient information or a withdrawal form, the withdrawal period will still expire 3 months after the goods have been received. If you have not received information about the right of withdrawal at all, the deadline will be 1 year. The notification from the buyer to the seller about the use of the right of withdrawal should be in writing (withdrawal form, e-mail, fax or letter), and it must contain information about how you want to return the item to Strie Strømmer.

When using the right of withdrawal, the item must be returned to Strie Strømmer within a reasonable time. Strie Strømmer is obliged to refund the full purchase price to the buyer within 14 days from the day Strie Strømmer receives the item or collection note or the item is made available to Strie Strømmer. Strie Strømmer cannot set fees for your use of the right of withdrawal, but Strie Strømmer may require you to pay the cost of the return shipment.

You can examine the product before you cancel the purchase. However, it must be possible to return the item to Strie Strømmer in approximately the same condition and quantity as when you received it. You should return the item to Strie Strømmer in its original packaging if possible.

You cannot cancel the purchase of goods that deteriorate rapidly, goods that by their nature cannot be returned, or sound and image recordings (including CDs, DVDs) or computer programs where the seal has been broken. The latter exception only applies if the seller has clearly and unambiguously stated the conditions for loss of the right of withdrawal on the seal.

11. Examination of the goods

When you receive the goods, it is recommended that you reasonably check whether they are in accordance with the order, whether they have been damaged during transportation or whether they are otherwise defective.

If the item does not correspond to the order or has defects, you must notify Strie Strømmer in the event of a complaint, cf. clause 12 of the contract.

12. Complaints in the event of defects, and deadline for reporting claims in the event of delay

If there is a defect in the goods, you must notify Strie Strømmer within a reasonable time after discovering it that you wish to invoke the defect.

The deadline can never be shorter than two months from the time you discovered the defect. However, complaints must be made no later than two years after you took possession of the goods. If the item or parts of it are intended to last significantly longer, the complaint period is five years. In the event of delay, claims must be made to the seller within a reasonable time after the delivery time has arrived and the goods have not been delivered.

If the item was paid for by credit card, you can also choose to make a complaint and send a claim directly to the credit provider (the credit card company). The notification to Strie Strømmer or the credit provider should be in writing (e-mail, fax or letter).

13. Your rights in case of delay

If Strie Strømmer fails to deliver the goods or delivers them late in accordance with the agreement between the parties, and this is not due to you or circumstances on your part, you may, according to the rules in Chapter 5 of the Consumer Purchases Act, withhold the purchase price, demand performance, cancel the agreement and claim compensation from Strie Strømmer.

Fulfillment: If Strie Strømmer does not deliver the goods at the time of delivery, you may maintain the purchase and set a reasonable additional deadline for fulfillment by Strie Strømmer. However, you may not demand performance if there is an obstacle that Strie Strømmer cannot overcome or if performance would cause such great inconvenience or cost to Strie Strømmer that it is significantly disproportionate to your interest in Strie Strømmer's performance. If the difficulties fall away within a reasonable time, the consumer may demand fulfillment. Termination: You may terminate the agreement with Strie Strømmer if the delay is substantial or if Strie Strømmer does not deliver the goods within the additional deadline for performance that you have set. However, you cannot terminate the agreement while the additional deadline is running, unless Strie Strømmer has said that they will not fulfill within the deadline.

Compensation: You may furthermore claim compensation for losses you suffer as a result of the delay on the part of Strie Strømmer, cf. section 24 of the Consumer Purchase Act.

You must report claims to Strie Strømmer in the event of a complaint, cf. clause 12 of this contract.

14. Your rights in the event of a defect

If the item has a defect and this is not due to you or circumstances on your part, you may, in accordance with the rules in Chapter 6 of the Consumer Purchase Act, depending on the circumstances, withhold the purchase price, choose between rectification and replacement, claim a price reduction, cancel the agreement and claim compensation from Strie Strømmer.

Correction or replacement: If the goods have a defect, you may demand that Strie Strømmer rectify the defect or redeliver equivalent goods. Strie Strømmer may oppose your claim if the implementation of the claim is impossible or causes Strie Strømmer unreasonable costs.

Strie Strømmer shall make the correction or replacement delivery within a reasonable time. Rectification or replacement shall be made at no cost to you, without the risk that you will not be reimbursed for your expenses and without significant inconvenience to you. Strie Strømmer may not make more than two attempts at rectification or replacement for the same defect, unless there are special reasons that make further attempts reasonable.

Even if you do not demand rectification or replacement, Strie Strømmer may offer rectification or replacement if this is done without delay. If Strie Strømmer arranges such rectification or replacement, you cannot claim a price reduction or rescission.

Price reduction: If the defect is not corrected or replaced, you can claim a proportionate price reduction.

Cancellation: Instead of a price reduction, you can cancel the contract, except when the defect is immaterial.

Compensation: You can also claim compensation for financial loss you suffer as a result of the item having a defect, cf. section 33 of the Consumer Purchase Act.

You must report claims to Strie Strømmer in the event of a complaint, cf. section 12 of this contract. The rules on complaints apply in addition to, and independently of, the rules on the right of withdrawal and any guarantees provided by the seller.

15. Strie Strømmer's rights in the event of your default

If you do not pay or fulfill the other obligations under the agreement, and this is not due to Strie Strømmer or circumstances on Strie Strømmer's part, Strie Strømmer may, in accordance with the provisions of Chapter 9 of the Consumer Purchases Act, withhold the goods, demand performance of the agreement, demand termination of the agreement and claim compensation from you. Depending on the circumstances, Strie Strømmer may also charge interest in the event of late payment, debt collection fees and fees for unclaimed goods not paid in advance.

Fulfillment: If you do not pay, Strie Strømmer may retain the purchase and demand that you pay the purchase price (fulfillment). If the goods have not been delivered, Strie Strømmer loses its right if Strie Strømmer waits an unreasonably long time to make the claim.

Termination: In the event of material default of payment or other material default by the buyer, Strie Strømmer may terminate the agreement. However, Strie Strømmer cannot terminate after the purchase price has been paid.

Strie Strømmer may also cancel the purchase if you do not pay within a reasonable additional deadline for performance set by Strie Strømmer. However, Strie Strømmer cannot cancel while the additional deadline is running, unless the buyer has said that he or she does not want to pay.

Compensation: Strie Strømmer may claim compensation from you for financial loss suffered as a result of a breach of contract on your part, cf. section 46 of the Consumer Purchase Act.

Interest on late payment/collection fees: If you do not pay the purchase price in accordance with the agreement, Strie Strømmer may charge interest on the purchase price in accordance with the Act on Interest on Late Payment.9 In the event of non-payment, the claim may, after prior notice, be sent for collection, and you may then be held liable for fees in accordance with the Act on Collection and other recovery of overdue monetary claims.

Fee for uncollected non-prepaid goods: If you fail to collect unpaid goods, Strie Strømmer may charge you a fee of NOK 500.00 + return shipping. The fee shall cover a maximum of Strie Strømmer's actual expenses for delivering the goods to you. Such a fee cannot be charged to buyers under the age of 18.

16. Warranty

A warranty provided by Strie Strømmer or the manufacturer gives you rights in addition to the rights you already have under mandatory legislation. A warranty does not therefore entail any limitations on your right to complain and make claims in the event of delay or defects in accordance with sections 11 and 12

17. Personal data

Unless you consent otherwise, Strie Strømmer may only collect and store the personal data that is necessary for Strie Strømmer to fulfill its obligations under the agreement. The personal data of buyers under the age of 15 cannot be collected unless Strie Strømmer has the consent of their parents or guardians. Your personal data will only be disclosed to others if it is necessary for Strie Strømmer to perform the agreement with you, or in statutory cases.

Strie Strømmer may only collect your personal identification number if there is a factual need for secure identification and such collection is necessary.

If Strie Strømmer wishes to use your personal data for other purposes, for example to send you advertising or information beyond what is necessary for the execution of the agreement, Strie Strømmer must obtain your consent when entering into the agreement. Strie Strømmer must provide you with information about what the personal data will be used for and who will use the personal data. Your consent must be voluntary and given by an active action, for example by ticking a box.

You should be able to easily contact Strie Strømmer, for example by phone or e-mail, if you have questions about Strie Strømmer's use of personal data or if you want Strie Strømmer to delete or change your personal data.

18. Conflict resolution

The parties shall attempt to resolve any disputes amicably. You can contact the Consumer Council for assistance in any dispute with the seller. If an amicable solution is not reached after mediation by the Consumer Council, the parties may request in writing that the Consumer Council submit the dispute to the Consumer Disputes Committee. The Consumer Disputes Committee's decision is legally binding four weeks after notification. Before the decision is legally binding, the parties may, by submitting a writ of summons to the Consumer Disputes Committee, bring the decision before the district court. See Act of April 28, 1978 no. 18 on the handling of consumer disputes.
